Obtaining the NIE: Your spanish tax ID

The NIE (Número de Identificación de Extranjero) is essential for any financial transaction in Spain. It can be obtained:

  • By applying personally to Spanish authorities
  • Via power of attorney through your lawyer

The power of attorney must be notarized, apostilled if done abroad, and translated into Spanish.

Granting power of attorney

This allows your lawyer to:

  • Sign documents on your behalf
  • Open a bank account
  • Obtain your NIE
  • Finalize the purchase with the notary

Legal and administrative checks

Your lawyer must verify:

  • The Nota Simple (legal status of the property)
  • The Certificate of Habitability
  • The Energy Performance Certificate
  • Any outstanding debts: taxes, utilities, or community fees

Signing the reservation contract

The Contrato de Arras formalizes the agreement between buyer and seller. It includes a deposit (usually 10%) and outlines the purchase terms and deadlines.

Signing the final deed with the notary

The final deed (Escritura Pública) is signed before a Spanish notary. They confirm legal compliance and register the sale in the land registry. Your lawyer can sign via power of attorney.

Plan for an additional 13% to 15% in costs:

  • Resale property: 10% (Valencian Community), 8% (Murcia)
  • New property: VAT (10% or 8%) + AJD (1.5% or 2%)
